Terms of Sale

1. Purchase & Payment

Payment is due in full at the time of purchase.

To initiate a purchase, please contact us directly at wendy@wendycaldwellmaloney.com. We will determine the best carrier, packaging, and delivery time frame for your order.

Invoices will be issued via email through Square, which accepts Visa, Mastercard, American Express, Discover, JCB, and UnionPay International. You may also pay by check mailed to the address provided on your invoice. 

To process and ship (or deliver) your order, we require a valid email address, a phone number with area code, and a valid shipping address that is not a PO Box. Please send all communications to wendy@wendycaldwellmaloney.com to ensure proper documentation for both parties.

2. Shipping & Delivery

We will arrange for shipping on your behalf. Shipping costs will be calculated individually based on the destination, package size and weight, and any special requirements you may request regarding delivery time frames. We currently offer shipping only within the United States. Once shipping details are confirmed, you will receive an invoice for payment. 

Risk of loss passes to the carrier when your order is shipped. We are not responsible for shipping delays or damages caused by the carrier. If artwork arrives damaged, you must notify us via email to wendy@wendycaldwellmaloney.com within 24 hours of delivery and include photos of damage. We will assist you in filing a claim with the carrier, but we are not responsible for the outcome of the claim or for any damages incurred during shipping.

3. No Returns & Exchanges

All sales are final. No returns or exchanges. 

4. Copyright & Reproduction

Purchase of artwork does not transfer copyright. We retain all rights to reproduce the work. Artwork may not be copied, reproduced, or used for commercial purposes without written permission.

5. Governing Law & Dispute Resolution

These Terms of Sale are governed by the laws of the State of New York. Any disputes arising from or related to these terms shall be resolved exclusively in the state courts located in Erie County, New York.

6. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages related to the sale or use of the artwork.
